On February 27, 2006 the Plaintiff was the operator of a 2000 Pontiac Grand Am. The accident occurred at approximately 10:15am at the intersection of Webster and Union Streets in Manchester. As the Plaintiff operated with due care and caution he observed a vehicle executing a left turn from Webster to Union into his path of travel. This accident occurred on August 10, 2008, a Sunday, at approximately 9:43 p.m. in Manchester, New Hampshire. The Plaintiff was traveling to the area of the accident to pick up her husband from the home of a family member. At the time of this accident the Plaintiff was traveling on the ramp from Route 128 to Route 9 in Wellesley, Massachusetts when she was struck from behind by the Defendant, a resident of Lowell Massachusetts. The Defendant reported to the investigating officer that he was insured by Safety Insurance Company but, it was later determined that the policy had been cancelled and the vehicle was uninsured.
